Boat owners can also showcase their vessels to a global audience, connecting with marine enthusiasts. Our services focus on facilitating the booking and rental of boats, providing a seamless experience between customers and service providers.
2. Definitions
"We" or "Us" refers to Take A Boat.
"Customer" means individuals renting boats or booking packages from Take A Boat.
"Service Provider" refers to boat owners, vendors, tour operators, or anyone responsible for the operation of boats and packages.
"Users" means both customers and service providers.
3. Description of Services
We provide services in boat, ship, cruise, yatch rental, booking, and marine tourism packages. Take A Boat operates as a booking engine, ensuring the availability of boats and handling the booking process. While we are committed to ensuring that service providers meet their commitments, we are not responsible for organizing trips themselves. However, in cases where service providers fail to meet commitments, Take A Boat will intervene on behalf of customers to ensure proper resolution. We prioritize the security of both customers and service providers.
4. User Obligations
Eligibility: To access and use Take A Boat services, users must register an account. Users must be 18 years or older.
Verification Requirements: All users must provide accurate and current information during registration and verify their email address and phone number.
Customers must use their legal name and provide a valid identity document (national ID card, passport, or driving license).
Service providers must use their business name, backed by a valid trade license.
Foreign Tourist Policy: Foreign tourists are required to submit their passport (via email or a secured link) to comply with legal requirements in Bangladesh for their security.
Obligations to Keep Information Up-to-Date: Users are responsible for ensuring that their account information, including contact details and payment information, is kept up-to-date. Failure to update information may result in the inability to receive services, updates, or notifications from Take A Boat.
Account Security: Users are responsible for maintaining the security and confidentiality of their account login credentials. Any unauthorized access or activity on the account must be immediately reported to Take A Boat. We are not liable for any losses resulting from unauthorized access to a user’s account due to their failure to safeguard login information.
5. Bookings and Payments
Payment Methods: We support online payments via Mobile Financial Services (bKash, Nagad, Upay, Tap), credit/debit cards (Visa, Mastercard), and bank payments.
Payment Policies: Customers are required to make full or partial payments to confirm bookings. Service providers may charge additional service fees where applicable. Take A Boat does not have hidden charges, and all fees are disclosed at the time of booking.
6. Cancellation, Refunds, and Modifications
Cancellation Policy: Cancellations and refunds are governed by the service provider's specific policies. The service provider’s cancellation terms will be available at the time of booking.
Penalties for Late Cancellations: As per the service provider’s policy, penalties may apply for late cancellations or no-shows.
Modifications: Any booking changes must be agreed upon by both the customer and the service provider. Take A Boat assists in facilitating booking modifications where applicable.
7. Customer Responsibilities
Customers must behave politely with service providers and boat operators. They are responsible for:
Maintaining Cleanliness: Customers are expected to leave the boats and related facilities in the same condition they were in when they boarded.
Compliance with Safety Regulations: All safety measures imposed by the service provider must be followed.
Damage to Boats or Assets: Customers are obliged to use the property, entertainments and equipments with care to avoid any damage.
8. Liability Limitations
Take A Boat is not liable for customers’ personal belongings during trips. However, if belongings are entrusted to the service provider and lost or stolen, and if the event is classified as a criminal offense, Take A Boat will offer legal support to the customer.
In the case of accidents or injuries resulting from the service provider’s negligence, the service provider is responsible for compensating the guest for any damages incurred.
If a customer causes damage to the boat or its assets, whether through negligence or intentional actions, the service provider must immediately report the issue to Take A Boat.
9. Dispute Resolution and Compensation
Good Faith Negotiation: For any nature of damage. Take A Boat encourages both customers and service providers to negotiate compensation in good faith.
Arbitration Role: If no agreement is reached, Take A Boat will intervene to determine fair compensation, which may be recovered from the party liable for the damage or through insurance (if applicable). If disputes cannot be resolved, Take A Boat may escalate the matter to law enforcement if necessary.
Jurisdiction: Disputes are subject to the laws of the country where the service is provided. If international customers are involved, international conventions may apply.
10. Taxes
Tax Handling: All taxes are the responsibility of the beneficiaries (customers and service providers). However, Take A Boat will deduct or charge taxes at the source if required by the local authorities.
Tax Reporting: Take A Boat may provide sales invoices or revenue reports, but will not issue tax challans unless enforced by local tax authorities.
11. Intellectual Property and Content
Property Listings: Service providers are responsible for ensuring that any images, descriptions, or other media used in listings are owned by them or have proper permission from the rightful owner. Unauthorized use of content is prohibited.
Customer Reviews: Customer reviews should reflect accurate, honest feedback. Take A Boat does not verify the authenticity of reviews, but reserves the right to remove reviews that violate our content policies.
12. Platform Rules
Users must provide accurate information during registration and booking processes.
Users are prohibited from engaging in illegal activities, including but not limited to unauthorized parties or events, human trafficking, or offering prohibited services.
13. Termination, Suspension, and Other Measures
Termination by the User: You may terminate your account at any time by emailing Take A Boat or deleting your account from the platform.
Termination by Take A Boat: We reserve the right to terminate or suspend your account for violations of these Terms, applicable laws, or other Take A Boat policies.
Effect of Termination: Upon termination, any confirmed bookings will be automatically canceled. Refunds will depend on the service provider’s policies.
14. Force Majeure
In the event of unforeseen circumstances, such as natural disasters, national crises, pandemics, or travel restrictions imposed by legal authorities, both customers and service providers have the right to cancel bookings without penalties.
15. Intellectual Property
All intellectual property related to Take A Boat, including logos, trademarks, and platform content, remains the property of Take A Boat. Users are not permitted to copy, distribute, or modify Take A Boat’s intellectual property without prior written consent.
16. Third-Party Services
Take A Boat may provide links to third-party services (such as payment gateways or external service providers), but we are not responsible for the content or services provided by these third parties. Users who interact with third-party services are subject to the terms and policies of those services.
17. Modifications to Terms
Take A Boat reserves the right to modify these Terms and Conditions at any time. We will notify users of material changes via email or platform notifications at least 30 days before the new terms become effective.
18. Governing Law and Jurisdiction
Governing Law: These Terms and Conditions are governed by the laws of Bangladesh, and any disputes or claims arising from the use of Take A Boat or its services will be resolved in accordance with Bangladeshi law.
Jurisdiction: In case of disputes that cannot be resolved through negotiation or arbitration as outlined in Section 9 (Dispute Resolution), the legal jurisdiction will be the courts of Bangladesh.
